1. Who We Are

FilmFights.AI is a brand and platform operated by Big Machine Productions LLC, a Minnesota limited liability company d/b/a bmp creative ("BMP"). BMP is the data controller responsible for the personal information collected through this Service. FilmFights.AI operates independently from BMP's other business lines, and personal information collected through FilmFights.AI is not shared with or used by BMP's other operations.

When these Terms refer to "FilmFights.AI," "we," "us," or "our," they refer to BMP in its capacity as operator of the FilmFights.AI platform.

2. What We Collect

We collect information in three ways: information you give us directly, information generated by your use of the Service, and information from third-party tools we use to operate the platform.

Information You Provide

Account information: When you register, we collect your name and email address. You may optionally add a profile photo, bio, or links to your work.

Submission data: When you enter a Fight, we collect your film submission along with any associated metadata you provide, including descriptions of the AI tools and techniques used to create your film.

Prize and tax documentation: If you win a cash prize, we collect the information required to process payment and comply with tax law, including your legal name, mailing address, and tax identification number (e.g., IRS Form W-9 for U.S. residents). This information is collected through our third-party payment processor and may be shared with us to comply with our tax obligations.

Communications: If you contact us by email or through the platform, we retain those communications.

Community activity: Feedback you leave on other participants' films, votes you cast, and comments you post are collected and associated with your account.

Information We Collect Automatically

Usage and video analytics: We collect data about how you interact with the Service, including pages visited, films viewed, session duration, and engagement patterns. This data is collected through site analytics tools and through embedded video platforms (YouTube and Vimeo) which may collect their own data about video playback. Please refer to YouTube's and Vimeo's respective privacy policies for details on their data practices.

Log data: Our servers automatically collect standard log information including IP addresses, browser type, device type, operating system, and timestamps when you access the Service.

Cookies and similar technologies: We use cookies and similar tracking technologies to keep you logged in, remember your preferences, and analyze traffic. We use Google Analytics, which associates IP addresses with browsing behavior on our platform. See Section 6 for more detail on cookies and your opt-out options.

Aggregated and anonymized data: We may aggregate and anonymize usage data for internal analysis and platform improvement. Aggregated data does not identify individual users and is not subject to this Privacy Policy.

Information from Third Parties

We use third-party services to operate the platform. These include our payment processor (Tremendous), video hosting platforms (YouTube and Vimeo), email delivery tools (such as Mailchimp), and site analytics (Google Analytics). These services may share certain data with us as part of their normal operation. We do not purchase data about you from data brokers.

3. How We Use Your Information

Running competitions: We use your account information and submission data to administer Fights, communicate results, and provide the core features of the Service.

Prize fulfillment and tax compliance: We use payment and tax documentation to send prizes and issue required tax forms (e.g., IRS Form 1099-MISC for U.S. residents with winnings of $600 or more in a calendar year).

Community features: Feedback, votes, and comments you submit are displayed to other community members as part of the core competition experience.

Communications: We use your email address to send competition updates, results announcements, and platform news. You can opt out of marketing emails at any time using the unsubscribe link in any email we send. Transactional emails (e.g., competition and results updates, prize notifications, account security alerts) cannot be opted out of while your account is active and part of a Fight.

Platform improvement: We use aggregated and anonymized usage data to understand how the Service is used and to improve it over time.

Legal compliance and safety: We may use your information to comply with applicable law, respond to legal process, enforce our Terms of Service, and protect the safety and integrity of the platform.

4. How We Share Your Information

We do not sell your personal information. We do not share personal information collected through FilmFights.AI with BMP's other business lines or affiliated entities. We share your information only in the following circumstances:

Service providers: We share information with vendors who help us operate the platform, including Tremendous (prize payments), YouTube and Vimeo (video hosting), email delivery providers, and Google Analytics (site analytics). These vendors are contractually required to use your data only to provide services to us.

Tax authorities: We are required by law to report prize payments to the IRS and may share relevant information with tax authorities as required.

Legal requirements: We may disclose information if required by law, subpoena, court order, or other legal process, or if we believe disclosure is necessary to protect the rights, property, or safety of FilmFights.AI, our users, or the public.

Business transfers: If FilmFights.AI or BMP is acquired, merged with another company, or its assets are sold, your information may be transferred as part of that transaction. We will notify you via email or prominent notice on the Service before your information is transferred and becomes subject to a different privacy policy.

With your consent: We may share your information in other circumstances with your explicit consent.

5. How Long We Keep Your Information

Account data: We retain your account information for as long as your account is active. If you delete your account, we will delete or anonymize your personal information within 90 days, except where we are required to retain it for legal or tax purposes.

Submission data: Films you submit to FilmFights.AI may be retained indefinitely for archival and promotional purposes, consistent with the license grant in our Terms of Service. You retain copyright in your submitted films.

Tax records: We are required to retain prize payment records and associated tax documentation for a minimum of seven (7) years under U.S. tax law.

Usage logs: Server logs and analytics data are typically retained for 12 months and then deleted or anonymized.

6. Cookies and Tracking Technologies

We use cookies and similar tracking technologies to operate the Service. A cookie consent banner is displayed when you first visit the Service, giving you the opportunity to manage your cookie preferences before non-essential cookies are set.

Essential cookies: Required for the Service to function. These include session cookies that keep you logged in and security cookies that protect against fraud. You cannot opt out of these without losing access to the Service.

Analytics cookies: We use Google Analytics to understand how people use the Service. Google Analytics collects data including IP addresses and associates them with browsing activity on our platform. You can opt out of Google Analytics tracking by using the Google Analytics opt-out browser add-on available at tools.google.com/dlpage/gaoptout, or by declining analytics cookies in our cookie consent banner.

Preference cookies: These remember your settings and preferences across sessions.

7. Your Rights and Choices

We honor the following rights for all users regardless of jurisdiction:

Correction: You can update most of your account information directly in your account settings. For information you cannot update yourself, contact us at admin@filmfights.ai.

Deletion: You can request deletion of your account and personal information by contacting us at admin@filmfights.ai. We will process deletion requests within 90 days, subject to any legal retention obligations.

Opt-out of marketing: You can unsubscribe from marketing emails at any time using the unsubscribe link in any email we send, or by contacting us at admin@filmfights.ai.

Cookie opt-out: You can manage cookie preferences through our cookie consent banner on arrival, through the cookie settings link in the footer, or through your browser settings.

Residency Privacy Rights: You may have certain additional rights, including the right to know what personal information we have collected, the right to opt out of the sale of personal information (we do not sell personal information), and the right to non-discrimination for exercising your privacy rights, depending on where you live. 8. Data Security

We use industry-standard technical and organizational measures to protect your personal information from unauthorized access, disclosure, alteration, or destruction. These measures include encrypted data transmission (HTTPS), secure password storage, and access controls on our systems.

No method of transmission over the internet or electronic storage is completely secure. While we work hard to protect your information, we cannot guarantee absolute security. If we become aware of a breach that affects your personal information, we will notify you as required by applicable law.

9. Children's Privacy

The Service is intended for users who are 18 years of age or older. We do not knowingly collect personal information from anyone under the age of 18. If we become aware that we have collected personal information from a minor, we will delete that information promptly. 10. International Users

FilmFights.AI is operated from the United States and is currently directed at U.S. residents. If you are accessing the Service from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your country.

Nevertheless, depending on where you reside, you may have certain rights with respect to the data we collect, including, the right to be informed about the data collected and processed, access to your data, the right to correct and update data, the right to request erasure of your data, the right to restrict certain processing of your data or object to how your information is used, and the right to opt out of certain automated practices. 11. Third-Party Links and Services

The Service may contain links to third-party websites or integrate with third-party platforms including YouTube, Vimeo, Tremendous, and email marketing tools. This Privacy Policy does not apply to those third-party services. We encourage you to review the privacy policies of any third-party services you use in connection with FilmFights.AI.

12. Changes to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you by updating the "Last Updated" date at the top of this document and/or, where appropriate, by sending you an email. Your continued use of the Service after any changes constitutes acceptance of the Privacy Policy, as updated.
