DMCA & Copyright Policy

1. Reporting Copyright Infringement

If you are a copyright owner, or authorized to act on behalf of one, and believe that material on FilmFights.AI infringes your copyright, you may submit a written notification of claimed infringement ("DMCA Notice") to our Designated Copyright Agent.

Your DMCA Notice must include substantially the following:

(a) A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;

(b) Identification of the copyrighted work claimed to have been infringed (or, if multiple works are covered by a single notification, a representative list of such works);

(c) Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or disabled, with information reasonably sufficient to permit us to locate the material (such as the URL of the submission);

(d) Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and email address;

(e) A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and

(f) A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages.

2. Designated Copyright Agent

DMCA Notices and counter-notifications must be sent to our Designated Copyright Agent registered with the U.S. Copyright Office:

Notices sent to addresses other than the Designated Agent or that do not comply with the DMCA's requirements may not receive a response.

3. Counter-Notification

If you believe that material you posted to FilmFights.AI was removed or disabled by mistake or misidentification, you may submit a counter-notification to our Designated Copyright Agent containing substantially the following:

(a) Your physical or electronic signature;

(b) Identification of the material that has been removed or disabled and the location at which the material appeared before it was removed or disabled;

(c) A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material; and

(d) Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which FilmFights.AI may be found), and that you will accept service of process from the person who provided the original DMCA Notice or an agent of that person.

Upon receipt of a valid counter-notification, we may restore the removed material in 10 to 14 business days unless the original complainant files an action seeking a court order against you.

4. Repeat Infringer Policy

FilmFights.AI will, in appropriate circumstances and in our sole discretion, terminate the accounts of users who are determined to be repeat infringers. We may also limit access to the Service or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

5. AI-Generated Content

FilmFights.AI is a competition platform for AI-generated short films. Submissions are created by participants using third-party AI tools, and submitters represent and warrant under our Terms of Service that their submissions do not infringe third-party rights. FilmFights.AI does not pre-screen submissions for potential infringement and relies on the DMCA process described above to address claims of infringement.

Nothing in this policy limits FilmFights.AI's right to remove content for any reason consistent with our Terms of Service.

6. Changes to This Policy

We may update this DMCA & Copyright Policy from time to time. Material changes will be reflected by updating the "Last Updated" date at the top of this page.
